The following words and expressions, beginning with a capital letter, whether in the singular or plural, are used herein with the following meanings:

"Administration": refers to the State, represented by the Digital Services Department as concerns the provision of this website.
"Website": refers to the present website, which is accessible via the following link: https://archives-annuaire-officiel.gouv.mc/
"User": refers to any natural person of legal age who accesses this website.

PURPOSE OF THE WEBSITE

This website, implemented by the Administration, allows all of the digitised editions of the Official Directory of the Principality of Monaco since 1877 to be presented and made publicly available, along with the maps of the Principality that they include.

INTELLECTUAL PROPERTY

Some of the content on the pages of the Website may be protected by intellectual property rights. These Legal Notices do not imply any transfer of intellectual property rights to the User.

A. Copyright

All the rights related to any content published on this Website are the exclusive property of the Administration, unless otherwise stated as assigning the property to a third party. This includes, but is not limited to, all texts, comments, titles, names, photographs, sounds, images, data, drawings, sound sequences, videos, functionalities graphic charts, organisation, presentations, listings and architecture, and these are protected by the legal provisions in force relating to the protection of copyright in Monaco.

With the exception of Website content belonging to third parties, the State grants the User a non-exclusive, non-transferrable and revocable worldwide free licence, allowing the User to use, depict, reproduce and disseminate by any means and via all media, the Website content for which it is the author or publisher. However, any use of the website’s contents for commercial purposes, or for a purpose or reason similar to that of the Website, is subject to prior authorisation from the State. Any substantial reuse (including the extraction of information) of the contents of the Website or of the directories is also subject to authorisation from the State. With regard to content that is covered by the intellectual property rights of third parties, the User must obtain the necessary authorisations from the holders of the intellectual property rights or their successors before making any use of the content.

The User shall also respect the integrity of the information derived from this Website, and ensure that no alterations are made to its substance and scope. The trademarks and/or logos owned by the State that appear on this Website are trademarks that are protected by the legal provisions applicable in Monaco. Any reproduction, in whole or in part, without the authorisation of the holder, constitutes a criminal offence punishable by the Monegasque Courts and Tribunals.

HYPERTEXT LINKS

The creation of hypertext links to this Website is not subject to any prior authorisation from the Administration and is authorised for any medium, with the exception of those disseminating information of a controversial, pornographic or xenophobic nature or that may, to a greater extent, be prejudicial to the sensitivity of the greatest number of people. The explicit mention of the State of Monaco in the title of the link is requested. The Administration reserves the right to request the removal of any existing links that contravene the purpose of the website.

This website of the Administration may contain hypertext links to external websites. The Administration does not monitor these sites and cannot under any circumstances be held responsible, in any way whatsoever, for content published on these external sites.

APPROVAL FROM THE DATA PROTECTION AUTHORITY OF MONACO

The website of the Official Directory, which supports the publication of the archives of the Official Directory of the Principality of Monaco, has been favourably received by the Data Protection Authority of Monaco, by deliberation n° 2019-80 of 15 May 2019 of the Data Protection Authority of Monaco, issuing a favourable opinion on the implementation of automated processing of personal information for the purpose of “Publishing the archives of the Official Directory of the Principality of Monaco on the Internet”, presented by the Minister of State and published in the Journal de Monaco on 07 June 2019
